1.1 Steve Or Webdesign strives to provide and maintain a first class service level in respect to the Client. read what Client's say
1.2 Agreements and delivery of Deliverables are always honored, in the event of Steve Or Webdesign's inability to keep such agreements due to circumstances or otherwise, the Client will be duly informed and new agreements made.
2.1 Steve Or Webdesign will register the Client's domain name and according to the Client's needs and budget, offer the best hosting environment via trusted third party hosting companies. In selecting the best hosting package, site performance and security are considered important, as are the service levels of the hosting company toward it's clients.
2.2 Steve Or Webdesign may or may not accept the project if the Client has already placed the hosting with a hosting company, depending on the suitability of the said hosting package or company. In case of unsuitability, the costs of transferring domain name or hosting will be billed to the Client unless otherwise stated in the Proposal.
2.1 Any website, regardless of the security measures installed, can be hacked or damaged by an unsuccessful hack attempt. At best, good security measures will greatly reduce the possibility of such an attack by minimizing site vulnerabilities. Responsibilities for the repair of subsequent damage are divided between your hosting company, Steve Or Webdesign and the Client.
2.2 The Hosting company is responsible for the security and maintenance of your server and database structure. When a server malfunction occurs, the hosting company should make repairs quickly and free of charge. Steve Or Webdesign does not guarantee and is not responsible for costs related to hosting failure or site downtime.
2.3 Steve Or Webdesign is responsible for implementing security measures at publication date, that provide good protection according to the limitations of your website's hosting set up.
2.4 The Client is responsible for the security of it's website and users information, the cost of repairs or any losses caused by a direct attack, random hack or attempted hack. It is advisable to use our Security Maintenance Package a yearly maintenance subscription that will reduce the risk of an attack, subsequent damage and repair costs.
3.1 The Client shall pay to Steve Or Webdesign fees described in the proposal / offerte within 7 days of the due date. Steve Or webdesign reserves the right to invoice with a payable 50% on placement of order and balance on completion.
3.2 Additional Costs. Any and all outside costs including photographer's costs and fees, photography and/or artwork licenses, image royalties, music licenses, and domain name or hosting fees, will be billed to The Client unless specifically otherwise provided for in the Proposal.
3.4 Project End. All deliverables shall be deemed complete once The Client has signed off the work or indicated satisfaction either verbally, in writing, via e-mail, post or other methods. If The Client fails to communicate with Steve Or Webdesign for a period of more than 30 days without explanation, the project shall be deemed satisfactory and complete.
4.1 General Changes. Unless otherwise provided in the Proposal, the Client shall pay additional charges for changes requested by The Client which are outside the scope of the Proposal on a time and materials basis. At Steve Or Webdesign standard hourly rate of 60 euro per hour. Such charges shall be in addition to all other amounts payable under the Proposal, despite any maximum budget, contract price or final price identified therein. Steve Or Webdesign may extend or modify any delivery schedule or deadlines in the Proposal and Deliverables as may be required by such Changes.
4.2 Substantive Changes. If The Client requests or instructs Changes that amount to a revision in or near excess of fifty percent (50%) of the time required to produce the Deliverables, Steve Or Webdesign shall be entitled to submit a new and separate Proposal to The Client for written approval. Work shall not begin on the revised services until a fully signed revised Proposal and, if required, any additional retainer fees are received by Steve Or Webdesign.
4.3 Post publication changes. Small changes that occur within one month from publication date may be completed free of charge, subject to the decision of Steve Or Webdesign.
5.1 The Client acknowledges that it shall be responsible for performing the following in a reasonable and timely manner:
(a) Coordination of any decision-making with parties other than Steve Or Webdesign.
(b) Delivery of The Client Content in a form suitable for reproduction or incorporation into the Deliverables without further preparation, unless otherwise expressly provided in the Proposal. Delivery of The Client Content will be made on time as per schedule regarding deliverables deadline.
(c) All media content is delivered royalty and licence free, or where required the royalties and licence fees are paid for website use.
(d) Final proofreading. In the event that The Client has approved Deliverables but errors, such as typographic errors or misspellings, remain in the finished product; The Client shall incur the cost of correcting such errors.
(e) Website security and costs of reparations due to successful or attempted hack attacks.
6.1 Steve Or Webdesign retains the right to reproduce, publish and display the Deliverables in Steve Or Webdesign's portfolios and Web sites, and in galleries, design periodicals and other media or exhibits for the purposes of recognition of creative excellence or professional advancement, and to be credited with authorship of the Deliverables in connection with such uses. Either party, subject to the other's reasonable approval, may describe its role in relation to the Project and, if applicable, the services provided to the other party on its Web site and in other promotional materials, and, if not expressly objected to, include a link to the other party's Web site.
7.1 Each party acknowledges that in connection with this Agreement it may receive certain confidential or proprietary technical and business information and materials of the other party, including without limitation Preliminary Works ( Confidential Information). Each party, its agents and employees shall hold and maintain in strict confidence all Confidential Information, shall not disclose Confidential Information to any third party, and shall not use any Confidential Information except as may be necessary to perform its obligations under the Proposal except as may be required by a court or governmental authority. Notwithstanding the foregoing, Confidential Information shall not include any information that is in the public domain or becomes publicly known through no fault of the receiving party, or is otherwise properly received from a third party without an obligation of confidentiality.
